The authors were involved in developing an ethical framework to assist the Queens Region Board (Prince Edward Island, Canada) set priorities in health and health care. Two and one half years after the adoption of this framework, the authors undertook an evaluation of the framework. This paper will discuss: a) the historical background of regionalization in Canada, and in particular the circumstances leading up to the institution of regional boards in Prince Edward Island; b) (...) the sorts of ethical issues facing the Queens Regional Board; c) issues arising in connection with the use and development of ethics frameworks for managing ethical issues in priority setting; d) the framework adopted by the Queens Board and the process that led to its development; e) issues arising as concerns implementation of the framework; f) questions and issues pertinent to other boards and bodies considering similar initiatives. At the beginning of his inquiry, Koch identifies two primary modes of human experience: solitude, the core definition of which is social disengagement, and encounter, that is to say, interaction with others. Both are essential for human completion; indeed, the inescapable link between solitude and encounter is illustrated in the book’s full title, which contains both words. Still, in today’s society solitude is probably less understood and appreciated than encounter, for we tend to stress the supposed primacy of relationships and bonds. Calling himself a partisan of solitude, Koch sets out to correct the imbalance he discerns between solitude and encounter by focusing on how solitude (different, he insists, from loneliness, isolation, privacy, or alienation) contributes to our physical, moral, and emotional well-being.Koch is a philosopher; he defines his terms and then, as he moves along, makes subtle distinctions in his original definitions, rendering each term ever more precise and accurate. Conscious of the slippage of meaning that often occurs in language and of the mischief that can be caused by using terms improperly, Koch points out how Tillich (p. 164) and Mijuskovic (p. 173) go astray by gliding confusedly from one term to another, the result being that their arguments drift into muddle. A meticulously learned book, Solitude is also a deeply meditative and an intensely personal one. In this, it resembles the work of Montaigne and of Loren Eiseley, where philosophical or (in the case of Eiseley) scientific knowledge is inseparable from imaginative vision; inseparable, too, from the distinctive voice of the author, for Koch, like Montaigne and Eiseley, moves easily from meditation to recollection, recounting moments of joy or sorrow in his own life. Mass-marketing frauds are on the increase. Given the amount of monies lost and the psychological impact of MMFs there is an urgent need to develop new and effective methods to prevent more of these crimes. This paper reports the early planning of automated methods our interdisciplinary team are developing to prevent and detect MMF. Importantly, the paper presents the ethical and social constraints involved in such a model and suggests concerns others might also consider when developing automated systems.

Edward Said was the quintessential intellectual of the last quarter of the twentieth century. Commonly celebrated as the founding figure of postcolonialism, his critical oeuvre spans varied terrain. The very strength of his critique lies in these diverse tributaries of thought. Crossing borders and boundaries incessantly, Said’s intellectual project celebrates the culture of resistance while opposing doctrinaire rhetoric. The paper tries to journey along the multifarious “margins” of discourses that crop up in Said. “In-between” spaces have to be investigated (...) for their radical potential, while daring to “transgress” has its own dangers. Said unmasks the unholy nexus between knowledge and power in the mapping of the “Orient” that abetted the colonial enterprise. His contrapuntal readings of literary texts reveal the ubiquitous presence of imperial empire. Consequently, voices from the margins spur counter narratives and “writing back” in the postcolonial condition. Intellectuals in exile tend to be “marginal” and this location helps in looking at the two or even three sides of an issue. Questions of identity, selfhood, nationality, politics, memory, history, representation, geography, homeland, anxieties of influence are dealt with in the paper. The intertwining of the personal and the political occurs in Said. “Memory” is the only hope for resuscitating a “lost world” and battling the accompanying sense of “loss” and “despair” infused in both individuals and communities alike. The paper tries to address how “border crossing” and the “coalescing of margins” create an interdisciplinary breadth in Said, which resist categorization. The “centre/margin” binary is problematized by acknowledging the presence of “many voices,” “polyphony” being a favourite concept of Said. Music gave to him metaphors for human emancipation, while “transgression” was vital. His acknowledgement and assimilation of fellow critics is also mentioned. Beyond enunciating insider-outsider distinctions, Said tried to cultivate knowledge as a bridge between different interests and locations. (shrink)

Tom Regan's seafaring dog that is justifiably thrown out of the lifeboat built for four to save the lives of four humans has been the topic of much discussion. Critics have argued in a variety of ways that this dog nips at Regan's Achilles heel. Without reviewing previous discussions, with much of which I certainly agree, this article develops an unexplored approach to exposing the vulnerability of the position that Regan takes on sacrificing the dog to save the humans. It (...) argues that when dealing with the seafaring dog, Regan abandons his own principles, and that this is exactly what he should do. This paper responds to the reviews by Edwards, Holm, Koch, Thomas and Vehmas of Disability Rights and Wrongs . After summarising the recent history of disability studies as a discipline, it explores: the political nature of disability research, questions of ontology and definition, and the uses and abuses of the expressivist argument. Disability is an emerging field of enquiry and constructive debate is to be welcomed.

This paper critiques current arguments advancing the potential for transhumanism and a range of biological and pharmacological enhancements to better human flourishing. It does so from a historical perspective weighing the individualistic and competitive evolutionary theories of Darwin with the cooperative and communal theories of Prince Peter Kropotkin a generation later. In doing so it proposes the transhumanist and enhancement enthusiasts operate within a paradigm similar to Darwin’s, one that is atomist and individualistic. The critique, which considers the status (...) of those with cognitive, sensory and physical limits, advances a vision of society as a cooperative and communal rather than individualistic and competitive. Within this framework the argument is not one of either/or but on the lexicographical superiority of the communal and social over the individualistic and competitive ethos underlying both Darwin and most contemporary transhumanist literature. This reordering of priorities, it is argued, reflects advances in contemporary biology and evolutionary thinking. (shrink)

European Vision and the South Pacific, first published in 1960, is the most acclaimed of all Bernard Smith’s many texts on art history and cultural theory. In conjunction with its 1992 companion-piece, Imagining the Pacific, and supported by collations of art and cartography from Cook’s and other voyages, this work also established his reputation as a major presence in Pacific-centred research. Likewise, the ongoing influence of European Vision and the South Pacific has seen Smith claimed as a foundational figure in (...) post-colonial scholarship, as one who ‘anticipated’ aspects of Edward Said’s late-1970s analysis of orientalism. But while there are important parallels and overlaps in the thinking of this pair, their differences and divergences are at least as significant. Above all, Smith’s Pacific-centred writings need to be understood as the unique intellectual achievements they undeniably are. (shrink)

Tom Shakespeare’s important new book includes, among other topics, a persuasive critique of the social model of disability. A key component in his case against that model consists in an argument against the impairment/disability distinction as this is understood within the social model. The present paper focuses on the case Shakespeare makes against that distinction. Three arguments mounted by Shakespeare are summarised and responded to. It is argued that the responses adequately rebut Shakespeare’s case on this specific issue. Moreover, as (...) the engagement with Shakespeare’s argument illustrates, his claim to employ a critical realist perspective appears to be in considerable tension with the case he offers against the impairment/disability distinction. Based on seventeenth- and eighteenth-century accounts written by and for slavers, this article investigates the provisioning of the French Middle Passage. As the transatlantic trade in African captives developed, foodstuffs for the feeding of both Europeans and Africans figured prominently in a specifically Atlantic system of commodity exchanges. The trade in foodstuffs depended most heavily on African subsistence systems encountered along the coasts of West Africa, but a surprising quantity of French and other European foodstuffs were embarked specifically for the (...) Middle Passage, revealing, I argue, the precariousness of conditions of trade and of European slaving factories. As a key element of Atlantic political economy, the study of food and its transatlantic provisioning networks sheds light not only on the governance and regulation of the networks themselves, but also on the ability of early modern states to establish and maintain metropolitan control, on the growth of local, colonial forms of autonomy and authority, and on the complex systems of ‘national’ and colonial interdependence that lay behind the expansion of every Atlantic colony. I conclude that this study of provisioning demonstrates that however fractured and differentiated, imperial power was an irrefutable aspect of colonial continuity. (shrink)

Tom Stoppard's comedy Dogg's Hamlet, built from the materials of Ludwig Wittgenstein's Philosophical Investigations, might be one. Wittgenstein could only use previously acquired language to argue that social performance is a necessary prerequisite for the process of learning that meaningful language in the first place. But Stoppard's audiences can experience the inadequacy of a static, constative theory of language; then they can self-consciously undergo a (...) socialized process of meaningful language acquisition. Foucault makes clear in his later lectures that the notion of parrhesia has a long and varied history, which he merely sketches in his investigations of ancient politics and philosophy. Recent research extends and modifies Foucault’s genealogy of parrhesia as an aspect of the practice of the adviser or counsellor of a monarch or prince, showing how parrhesia informed notions of counsel at other times: in later antiquity, the middle ages as well as early modern Europe. Here we seek (...) to show that the ancient notion of parrhesia reappears as a graft in another domain of modern truth telling: that of bureaucracy in Britain, in the debates over the organisation of the offices of government, with the middle years of the nineteenth century a decisive moment of rupture. We consider the fate of bureaucratic frank counsel in our own era. Interpreters of Foucault’s later lectures on governmentality have analysed the consequences of neoliberal rule for the government of public servants during the era of Margaret Thatcher. Presenting a reappraisal of the era, we show how important counter-discourses also emerged in this era, bringing the ethics of office to the fore, as civil servants argued for the formal codification of bureaucratic ethics, including frank counsel, as they tried to defend their professional ethics. Our discussion therefore addresses a key, early moment in the emergence of the ideal of codifying frank counsel and bureaucratic ethics. We consider the consequences of codification, arguing that a deep ambivalence now characterises the way in which political authorities seek to govern this domain of ethical practice. (shrink)

Despite its importance, the linkage between genetic and cultural evolution has until now been little explored. An understanding of this linkage is needed to extend evolutionary theory so that it can deal for the first time with the phenomena of mind and human social history. We characterize the process of gene-culture coevolution, in which culture is shaped by biological imperatives while biological traits are simultaneously altered by genetic evolution in response to cultural history. A case is made from both theory (...) and evidence that genetic and cultural evolution are inseverable, and that the human mind has tended to evolve so as to bias individuals toward certain patterns of cognition and choice rather than others. With the aid of mathematical models we trace the coevolutionary circuit: The genes prescribe structure in developmental pathways that lay down endocrine and neural systems, imposing regularities in the development of cognition and behavior; these regularities translate upward into holistic patterns of culture, which can be predicted in the form of probability density distributions ; natural selection acts within human history to favor certain epigenetic rules over others; and the selection alters the frequencies of the underlying genes. The effects of genetic and cultural changes reverberate throughout the circuit and are consequently tested with the passage of each life cycle. In addition to modeling gene-culture coevolution, we apply methods from island biogeography and information theory to examine the cultural capacity of the genes, the factors determining the magnitude of cultural diversity, and the possible reasons for the uniqueness of the human achievement. Tom Shakepeare is an eminent, and somewhat controversial, contributor to disability studies. As he outlines, part of the explanation for his controversial status within that field stems from his engagement with disciplines outside it, including genetics and bioethics. For many in the field of disability studies, no genuine engagement should be sought with scholars in genetics or bioethics because—so the party line goes—these areas of study are inherently opposed to disability rights and otherwise pose genuine threats to the status of (...) disabled people. The present volume is unlikely to do much to reduce his controversial status.The book is divided into three parts. The first presents a detailed criticism of the social model with some, more positive, proposals concerning how disability is best conceived. The second part—perhaps the one that will be of most interest to JME readers—concerns bioethical issues in disability . The final part focuses on themes such as care, charity, intimacy and the role of the non-disabled in “the world of disability”.The main reason why this book is unlikely to reduce Shakespeare’s controversial status is that its central theme is a sustained attack on the so-called and widely held “social model” of disability. According to this model, the causes of disability lie in the social environment, not within the individual. So, change the social environment in appropriate ways, and disability disappears. Shakespeare illustrates the various ways in which this model is analytically flawed and has had a negative effect upon disability studies, research and the lives of disabled people. …. (shrink)

Emphasizing the Indo-Tibetan tradition while indebted to Euro-American philosophy, Empty Words belongs in a class with books such (...) as Tom Tillemans's Scripture, Logic and Language: Essays on Dharmakīrti and His Tibetan Successors (1999) and Matthew Kapstein's Reason's Traces: Identity and Interpretation in Indian and Tibetan Buddhist Thought (2001). Below is a précis of Empty Words, followed by remarks on some points that especially caught this reviewer's interest.The essays in Empty Words are gathered into three sections according to subject matter: (1) Madhyamaka, (2) Yogācāra, and (3) Ethics and Hermeneutics. There are five essays in section 1, clustered around three themes: Nāgārjuna's theory of causality (ch. 2, 4), parallels between Madhyamaka and the European skeptical tradition (ch. 1), and paradox in Madhyamaka (ch. 3, 5).Section 2 begins with an essay interpreting Vasubandhu on the three natures and three naturelessnesses, arguing that "Vasubandhu subordinates the naturelessnesses [End Page 196] to the natures pedagogically and describes them as characteristics of, but not (with the exception of the third) identical to the three natures" (p. 121). As for the other three essays in section 2, chapter 7 consists of a translation of and commentary on Vasubandhu's Trisvabhāvanirdes´a, chapter 8 presents an interesting experiment in cross-cultural interpretation in which the history of European idealism is viewed through a Buddhist idealist lens, and chapter 9 (one of the two previously unpublished essays in Empty Words—ch. 14 is the other) attempts to bring together Garfield's views on the limits of expressibility in Madhyamaka and his interpretation of the three natures in Yogācāra.Section 3 includes three essays concerning issues in ethics or political philosophy and two essays discussing the hermeneutical issues involved when Euro-American and Tibetan philosophers attempt to understand each other's traditions. The topics of the former essays are as follows. Is the Dalai Lama's advocacy of human rights (which are grounded in liberal moral theory) compatible with Buddhist ethics, which emphasizes a compassion-based morality (ch. 10)? Are Buddhist values and democracy incompatible (ch. 11)? How does Samdhong Rinpoche's approach to nonviolence relate to Gandhi's (ch. 12)? In the final two essays of the book, Garfield advocates a strategy of cross-cultural interpretation which would avoid the pitfall of orientalism, drawing heavily on Gadamerian-Heideggerian hermeneutics.The remarks that follow bear exclusively on points from essays in section 1 on Madhyamaka. In chapter 4, Garfield critiques the claim, attributed to Dharmakīrti (by rGyal tshab in his commentary on the pramānasiddhi chapter of Pramānavarttika) that belief in rebirth is necessary for the cultivation of bodhicitta. Garfield argues that if this claim is correct, then the "I" in the bodhisattva vow is doing real metaphysical work, functioning as the basis for a real causal relation, contra Nāgārjuna's analysis of causality (which is supposed to involve the rejection of real causal powers). Otherwise, a simpler account of bodhicitta would suffice, in which striving for personal enlightenment could be replaced by striving for someone's attaining enlightenment some time in the future. On this account, practitioners would resolve to contribute to the accumulation of causes of someone's eventually attaining enlightenment, where this accumulation of causes turns out to be something like "universal moral improvement."But what if practitioners just do not know how to bring about universal moral improvement? Garfield acknowledges that buddhas sometimes act counter to the "moral" good, and this suggests an important cognitive difference between buddhas and ordinary beings: ordinary beings can only (fallibly) infer what the best thing to do is, whereas buddhas simply know. An attractive semantic theory presented by Richard K. Larson and Peter Ludlow takes a report of propositional attitudes, e.g 'Tom believes Judy Garland sang', to report a believing relation between Tom and an interpreted logical form constructed from 'Judy Garland sang'. We briefly outline the semantic theory and indicate its attractions. However, the definition of interpreted logical forms given by Larson and Ludlow is shown to be faulty, and an alternative definition is offered which matches their intentions. This definition is (...) then shown to imply that Tom does not know his own mind, a result without intuitive support. A third definition is offered to deal with this problem. (shrink)

We present a matrix model for the study of the population dynamics of brown trout Salmo trutta L., introduced in the '60s in the virgin aquatic ecosystems of the Kerguelen Islands. This species clearly acclimatized very well: a portion of the population became migratory and spent a part of its life cycle in the sea, which allowed the rapid colonization of two rivers close to the stream of origin in the same bay (Baie Norvégienne).These migratory trout can become a smolt (...) at 2, 3, or 4 years of age. The model takes into account age and smolt age structures and in a first step considers the fish from the Baie Norvégienne as belonging to a single population. The transition matrix looks like a 32 × 32 Leslie matrix in which some survival rates are not on the subdiagonal. They represent survival after the first sea migration and are particularly important for the dynamics of the whole population. (shrink)

A specter is haunting sociologists. It is the specter of “mass society.” This phantasm is not of the sociologist's own making. The conception of mass society, that had its origin in the Roman historians’ idea of the tumultuous populace and its greatest literary expression in Coriolanus, is largely a product of the nineteenth century. In this epoch, it is a product of the reaction against the French Revolutions which ran from 1789, through 1830 and 1848, to 1871. Jakob Burckhardt and (...) Friedrich Nietzsche, fearful of the inflammability of the mob in the presence of a heated demagogue—that demagogue was Louis Napoléon—came to envisage modern society, particularly modern democratic society, as tending toward an inert and formless mass, lying in brutish torpor most of the time and occasionally aroused to plebiscitary acclamation by a “great simplifier.” Tocqueville's critique of the absolutist ancien régime, centered on a vision of a society which has lost its framework of feudal liberty through the destruction of the autonomous corporations and estates on which it rested, is a cornerstone of that construction. The no-man's land between the absolute prince and the mass of the population became a field open to passion and manipulation. (shrink)

Machiavelli can be read as a plebeian thinker supportive of plebeian institutions that, as such, differentiate the few from the many and aim to regulate and burden the few. Yet, like numerous contemporary plebeian thinkers, Machiavelli is mostly silent about the moral transgressiveness required by the advocacy of plebeian institutions and ideas. The theses offered here argue that advocates of plebeianism will need, like the Machiavellian prince, to learn how not to be good. In explaining what this means in (...) practice, the theses also defend the propriety of anachronistic readings, caution again plebeian violence, and explain other dynamics of plebeian leftism. Despite its importance, the linkage between genetic and cultural evolution has until now been little explored. An understanding of this linkage is needed to extend evolutionary theory so that it can deal for the first time with the phenomena of mind and human social history. We characterize the process of gene-culture coevolution, in which culture is shaped by biological imperatives while biological traits are simultaneously altered by genetic evolution in response to cultural history. A case is made from both theory (...) and evidence that genetic and cultural evolution are inseverable, and that the human mind has tended to evolve so as to bias individuals toward certain patterns of cognition and choice rather than others. With the aid of mathematical models we trace the coevolutionary circuit: The genes prescribe structure in developmental pathways that lay down endocrine and neural systems, imposing regularities in the development of cognition and behavior; these regularities translate upward into holistic patterns of culture, which can be predicted in the form of probability density distributions ; natural selection acts within human history to favor certain epigenetic rules over others; and the selection alters the frequencies of the underlying genes. The effects of genetic and cultural changes reverberate throughout the circuit and are consequently tested with the passage of each life cycle. In addition to modeling gene-culture coevolution, we apply methods from island biogeography and information theory to examine the cultural capacity of the genes, the factors determining the magnitude of cultural diversity, and the possible reasons for the uniqueness of the human achievement.
